A young Brisbane man’s attempt to have his drug utensil charge thrown out didn’t get very far, with a magistrate telling him he would need to enter a plea.

Joshua Harry Law represented himself at Murgon Magistrates Court, asking magistrate Andrew Sinclair to dismiss his charge of possessing a bong.

“I’m seeking to have the charge thrown out, Your Honour. I have a script for medical marijuana,” Law said.

The charge related to a bong police found during a search warrant at his mother’s property in Wondai in May.

Prosecutor Barry Stevens told the court Law’s mother had initially been charged with possessing the item, but Law who had moved to Brisbane in March sent a statutory declaration saying it belonged to him.

Magistrate Sinclair didn’t entertain Law’s request for a dismissal, telling him he would need to either contest the charge at a later date or plead guilty.

“I don’t understand what the problem is. Your Honour, it’s a legal medication. I’m required to inhale it,” Law replied.

Mr Sinclair told Law he “never had a matter like that run to trial”, but that Law would could enter a not guilty plea and contest the charge at a later date once the police had complied a brief of evidence.

Law then said he simply wanted to get the charge dealt with and pleaded guilty.

He was placed to a good behaviour bond of $250 for six months.

No conviction was recorded.
