A young mother was forced to shield her baby as her partner viciously attacked her in their home in what became a pattern of assaults.

Damian James Jurgensen assaulted the woman over a period of days, instigating arguments over what he later described as her “shit talking” and “things under my skin”.

Jurgensen had only been released from jail three months earlier, after he shot his brother in the leg with an illegal rifle in while he was “mucking around” with the gun.

He was released from custody after being sentenced to a 18-month suspended jail term in August 2021.

The 26-year-old was at home with his 28-year-old partner in Kingaroy on the afternoon of November 23, when he began arguing with her and accusing her of “shit talking”.

The Kingaroy Magistrates Court heard then struck her with a backhanded blow, knocking her into a door frame and causing her to blackout.

The following day, he instigated an argument and struck her again, causing her to fall.

Police prosecutor Lisa Manns said while on the ground, the victim “attempted to shield” her seven-month child who she was holding at the time.

Despite this, Jurgensen continued to rain down blows on his victim, the court heard.

On November 25, he again began ranting at his partner, claiming “things were under his skin and making him sick and trying to kill him” and that this was “all the fault of the victim”.

Sergeant Manns said he later backhanded her twice across the face in the bathroom while she was preparing her child for a bath, and pushed her head into the wall.

When police later attended the address to speak to Jurgensen, they found him hiding in the front room of the house.

Jurgensen pleaded guilty to three counts of assault and charge of unlicensed driving.

Lawyer Leanne McIntosh told the court her client was medicated for bipolar disorder, anxiety and depression and had a “difficult upbringing”.

Jurgensen was sentenced to nine months’ jail, fined $500 and disqualified from driving for three months.

He was released on immediate parole, with 92 days of pre-sentence custody declared as time served.
