IN AN unusual turn of events, a 22-year-old Roma man with five pages of criminal history actually asked the magistrate to send him to jail so he could “clear his head”.
John Paul Sullivan fronted the Roma Magistrates Court on October 28 for his attempt to break into a car then yelled at the owner “f--king c--t”... I’ll kill both of yous”.
The court heard about 5pm on August 25, a lady parked her Toyota Kluger Wagon at her friend’s home and had a clear view of her car from where she was sitting inside the house.
She witnessed Sullivan approach her car and attempt to open the door, however it was locked.
The lady walked outside as Sullivan began to walk away and yelled at him, “oi I saw that”.
Police prosecutor sergeant Heather Whiting said the defendant turned around yelled at the victim “white slag”, “f--king bitch”, “f--king c--t” and “racist bitch”.
The lady responded, “I saw what you did... I’m going to call the police you mongrel”.
Sullivan turned towards the victim and yelled “I’m going to kill both of yous”.
As he started to walk away from the victim, he picked up an unknown item and threw it at the car before getting into a car that pulled up beside him.
The defendant’s solicitor, Laurie Parker told the court his client was dealing with various family issues at the time of these offences.
“He instructed to me that he doesn’t want parole, he actually wants to go into custody,” Mr Parker said.
“He wants his suspended sentence activated and wants to go in there and clear his head.”
Mr Parker said his client is a “good, young fella” and very respectful to him but just needs direction in his life.
“He would be a good boxer or sports person and does have a partner in Cunnamulla that he cares about,” Mr Parker said.
Magistrate Peter Saggers asked the defendant what is so wrong in his life that he wants to go to jail.
Sullivan admitted that going to jail isn’t ideal, but he is worried about breaching parole and just wants to have a fresh start.
Sergeant Whiting stated that the prosecution believed Sullivan should serve actual time due to his lengthy criminal history.
“My issue is that he has quite an extensive history – five pages of history for such a young person,” she said.
“Of note is that on the last page, in March 2020, numerous suspended sentences were actually imposed and there were some terms of imprisonment after serving actual time in relation to that.”
Sergeant Whiting mentioned that Sullivan committed a stealing offence in 2019 and attempted to enter a premise in 2018.
“There’s several dishonesty offences on his criminal history,” she said.
Sullivan pleaded guilty to attempt to enter premises with intent to commit indictable offence, commit public nuisance, wilful damage and breach of bail.
In relation to the breach of bail, sergeant Whiting told the court Sullivan failed to report to police on August 31 and told officers “he thought he needed to report on Wednesdays which was two days later”.
Magistrate Saggers convicted Sullivan to six months imprisonment with immediate parole.
“All those offences happened while you were on a suspended sentence,” he said.
“You come here, you need to do something about it.
“And a way to do something about it would be on parole, you may not want to do it but it’s designed to help you.
“Because it’s becoming a cycle of you going to jail, coming out and going back.
“You are now 22, you will get to 30 and look back and it’s a waste of a life – it’s up to you, six months parole is what you make of it.”
The conviction was recorded.
