Randall Garrard files lawsuit against BH Mining and Civil for accident at Gladstone

A labourer is suing his former employer for more than $974,000 for multiple shoulder tears that he suffered after he was struck by a roll of piping that he and another worker were moving from a truck at Gladstone’s Red Mud Dam.

Randall Webb Garrard, 50, who lives in Mount Edwards, was employed by BH Mining and Civil to work as a leading hand and labourer in Gladstone.

The lawsuit was filed against BH Mining and Civil for $974,333.12 over the incident, which occurred on or about October 19, 2019.

According to court documents, BH Mining and Civil had excavated a trench at Red Mud Dam in Gladstone and required Mr Garrard and another worker to lay a roll of Megaflo piping in the trench.

Mr Garrard claimed due to the terrain, he and the other worker were required to roll the piping from the truck to the trench across the ground which was covered in rocks and gravel.

He claimed while moving the piping that he lost his footing and the end of the roll of piping struck him, knocking him off his feet.

He claimed he braced his fall by placing his left hand out and hyperextended his left shoulder.

He claimed he suffered multiple shoulder injuries, including tears to his tendons.

He claimed BH Mining and Civil failed to have a safe system in place to move the roll of piping close to the trench and that the incident was caused by negligence and a breach of contract by the company.

Due to Mr Garrard’s alleged injuries, he claimed he experienced much pain, suffering, discomfort and a significant loss of the amenities of life, as well as economic loss.

According to court documents, Mr Garrard returned to work for a period but was unable to continue working.

The lawsuit was filed in the Rockhampton Supreme Court by vbr Lawyers on August 30.

No defence had been filed by BH Mining and Civil.

Ms Garrard’s solicitor and BH Mining and Civil were contacted for comment but did not respond by time of publication.
