Travis Jack Jury applies for bail in Rockhampton Magistrates Court

A solicitor has argued a man who allegedly punched and kicked a heavily pregnant woman was “not likely to serve any actual time in custody” if found guilty.

A heavily pregnant woman was allegedly assaulted by the father of the child, who is accused of punching her in the face and kicking her while she was on the ground.

Travis Jack Jury, 32, is accused of assaulting the woman, who the Rockhampton Magistrates Court heard was 30 weeks pregnant.

The court heard the woman suffered some bruising.

Mr Jury was charged with assault occasioning bodily harm and applied for bail in court on July 17.

Defence lawyer Samantha Legrady argued her client should be granted bail because he was “not likely to serve any actual time in custody” if found guilty.

Ms Legrady said there would be case conferencing required in relation to the assault charge, “which may amend the facts if resolved and certainly make a difference in relation to sentencing”.

She said if granted bail, her client would reside with his mother-in-law in Bouldercombe and would comply to bail conditions, including that he not go to Gracemere and report to Rockhampton Police Station.

Police prosecutor Clancy Fox, who opposed bail being granted to Mr Jury, argued he was not at risk of serving too much time.

“If he is convicted of the allegations as they are he faces a period of imprisonment,” he said.

Mr Fox said the bail address “represents an arrangement that is not without risk”.

Acting Magistrate Paul Byrne responded that no grant of bail was without risk.

Mr Byrne granted Mr Jury bail with the conditions that he reside at the address in Bouldercombe, report once a week to Rockhampton Police Station, not contact the alleged victim, not go to Gracemere and not consume alcohol or illicit drugs.

Mr Byrne warned Mr Jury “as quickly as you may gain bail it can disappear”.

He adjourned Mr Jury’s matter to August 14.

Mr Jury did not enter any pleas to the charge.
