A truck driver accused of causing the crash that killed a nurse and senior patient in an ambulance at Stanwell in October 2021 will stand trial in the New Year, more than two years after the fatality.
Timothy Lee Wilson, 43, pleaded not guilty in Rockhampton District Court on December 1, 2022 to one count of dangerous operation of a motor vehicle causing the death of 65-year-old Maryborough nurse Ray Wyeth and 87-year-old patient Martyn House, who were both in the back of the ambulance.
It is alleged Mr Wilson was the driver of a truck that collided with the rear of the stationary ambulance after it stopped at a red light for roadworks on the Capricorn Highway just after noon on October 11, 2021.
Mr Wilson’s matter was mentioned in Rockhampton District Court on December 15 before Judge Jeff Clarke, where the court heard the matter was listed to go to trial on February 26, 2024.
“There are no known witness availability issues from the Crown’s perspective,” Crown prosecutor Tiffany Lawrence said.
“There has been no further communication in respect of a new defence report, and certainly one has not been served by the Crown, nor an application to exclude any further evidence.
“It can remain as listed.”
The court heard the matter would be mentioned before the trial on February 5, 2024.
Mr Wilson was on bail, which was enlarged.
