Lawyers involved in an alleged murder case, where police claim a North Rockhampton man died from injuries received during an alleged assault at a Lakes Creek house in 2021, are likely to seek a Magistrate’s Direction for the next step of the court process.

Hamid Hussein, 35, was charged with murder after a man died of severe head injuries in February, 2021.

It is alleged 32-year-old man Amanullah Mohammad sustained critical injuries as a result of an alleged assault at a Mackay Street house in the suburb of Lakes Creek, on Thursday, January 28, 2021, shortly before 10pm.

He died in hospital the following Saturday.

It is alleged Mr Mohammad was hit in the head with a wooden chair handle.

Rockhampton Magistrates Court heard on May 31 that Mr Hussein’s lawyer and police prosecutions have been unable to agree on elements of a cross-examination hearing at committal hand up.

Grant Cagney advised the court an application for a Magistrate’s Direction was likely to be filed in the near future.

Mr Hussein’s lawyers have previously had body-worn footage translated as most of the people talking to police in the footage did not speak English.

They also had an expense case granted.

An expensive case grant is approved for cases matching certain criteria, according to the Legal Aid Queensland website, including a brief of evidence having more than 2500 pages of material.

Mr Hussein’s matter was adjourned to June 28.
