A Samoan man allegedly stalked two women from a Central Queensland pub onto a bus and later “violently” assaulted another random woman and her dog with the intent to rape her, a court has heard.

Misiuaita Faamoetauloa Aisavali, 26, applied for bail in Rockhampton Magistrates Court on October 10.

Mr Aisavali was charged with one count each of assault with intent to commit rape and unlawful stalking, intimidation, harassing or abuse.

Police prosecutor Sergeant David Longhurst opposed bail for Mr Aisavali, arguing he was at risk of failing to appear and endangering the safety and welfare of others.

An interpreter was used to translate the court proceedings from English into Samoan for Mr Aisavali.

Sgt Longhurst said Mr Aisavali left a licensed premises at Biloela, followed two women and tried to get on a bus with them, however, was refused by the driver.

The court heard later about 2am Mr Aisavali approached a random woman and followed her before allegedly assaulting her “violently” and her dog until she managed to free herself and get help.

“They are significant allegations of serious violence and serious actions by the defendant,” Sgt Longhurst said.

“It’s predatory in nature.”

He said the Biloela Hotel had stated to police Mr Aisavali had a history of following women into the street.

Sgt Longhurst said Mr Aisavali was Samoan with limited ties to the community and Australia and had a passport and ticket booked in December.

Mr Aisavali’s solicitor, Felicity Davis, said the risk of her client failing to appear and reoffending could be mitigated with bail conditions.

Ms Davis said bail conditions could include her client surrendering his passport to police, not leaving Queensland, reporting daily to the Biloela Police Station, a 24 hour curfew, not attending any licensed premises or consuming any drugs or alcohol, and not contacting or approaching the alleged victim or any witnesses.

She said she had not been provided with an address of where her client would live if he were granted bail.

Magistrate Grace Kahlert said it was a “reasonably strong case” against Mr Aisavali.

“He has been identified on CCTV footage and was found in possession of clothing worn by the offender,” she said.

Ms Kahlert refused to grant Mr Aisavali bail.

He was remanded in custody with his matters adjourned to October 30.

Briefs of evidence were ordered.
