Mine worker Brendan Moisy caught speeding at Yeppoon while drunk

A Central Queensland mine worker’s actions have been described as “outrageous” after he drove at 152kmh while .226 drunk - all with a sober passenger in the car who could have driven.

A Central Queensland mine worker clocked 152kmh while .226 drunk in a drink driving incident that has been described as “outrageous”.

To make matters worse, he had a sober passenger in the car who could have driven.

Brendan Jeffrey Moisy, 39, pleaded guilty in Yeppoon Magistrates Court on February 9 to his latest drink driving offence.

Police prosecutor Sergeant Kevin Ongheen said that at 11.10am on January 16, police clocked Moisy driving a Holden ute towards Rockhampton at 152kmh in a 100kmh zone on Yeppoon Road.

Sgt Ongheen said police stopped Moisy and when questioned, he told officers he had been drinking since 6.30am.

Moisy returned a blood alcohol reading of .226.

Sgt Ongheen said Moisy had a previous similar offence (.229 - being in charge of a vehicle) on his history from 2020 which saw him get fined $1000 and disqualified from driving for seven months.

“He (Moisy) has a lengthy traffic record that is disturbing and similar offending dating back historically outside the five-year period,” Sgt Ongheen said.

Solicitor Grant Cagney said Moisy’s traffic history indicated he had “an unhealthy relationship with alcohol”.

Mr Cagney said Moisy worked at Adani mine as a “fly-in fly-out” miner.

Mr Cagney said on the day of the offence, Moisy was due back at work and he could not find his phone charger.

“And as silly as it sounds, he drove to the service station on Yeppoon Road to buy a new phone charger,” Mr Cagney said.

“His partner was in the car with him - she was absolutely sober and for whatever reason, he (Moisy) decided he would be the person that drove the vehicle.”

Magistrate Philippa Beckinsale then asked: “So when he told the police he was drinking from 6.30am... that’s normal?”

Mr Cagney replied: “Yes. On his day where he is going back to work. So basically he was going to get dropped to the airport in the afternoon, fly to camp, wake up the next day and start work.”

The court heard Moisy had engaged with a therapist for counselling the day before this offence occurred.

“He had already acknowledged that he was not coping (with issues in his life),” Mr Cagney said.

Before handing down penalty, Ms Beckinsale described Moisy’s offending as “outrageous”.

“And I am grateful that nothing worse happened and so ought you be,” she said.

Ms Beckinsale fined Moisy $1950 and disqualified him from driving for 15 months.

A traffic conviction was recorded.
