Meatworker Gabriel Misok jailed for rape of a Central Qld child

A fourth man has been jailed for sexual crimes committed against a CQ teen girl after he didn’t like what she said to him after he declared his love for her.

A fourth man has been jailed for sexual crimes committed against a Central Queensland teenage girl.

The girl, who can’t be named for legal reasons, has been identified in several court proceedings for different offenders since October this year.

Crown prosecutor Monique Bros-Wilshire told the Rockhampton District Court at the end of October that the girl’s name was in other files in the Department of Public Prosecutions office in Rockhampton.

The latest man to be convicted of a sex crime against the child, Gabriel Misok, 33, also assaulted her, the court heard.

Defence barrister Maree Willey said her client was heavily intoxicated the night of his offending and socialising with his housemates – others who worked at meatworks and hailed from other countries – along with the victim, her sibling and their friend.

Judge Jeff Clarke said Misok’s offending started with a common assault against his neighbours where he was rambling while holding his genitalia and watching the female neighbour until her husband confronted him and Misok apologised.

He said Misok then went back to his house and told the victim child he wanted to talk to her, led her upstairs, undressed her and had unlawful sex.

“Afterwards, Misok sat on the bed and told her he loved her,” Judge Clarke said.

“She told him she didn’t care.

“Misok told her to be quiet and gratuitously hit her to her face in some way that cause a blood nose.”

The victim left the room and her sister and friend berated Misok which turned into an altercation.

The victim left the house and Misok followed her, carrying a pair of scissors, called her name and struck her face, causing a two centimetre laceration to her cheek adjacent to her nose.

Judge Clarke said her sister and friend, along with the neighbours all intervened which led to another altercation with the scissors taken from Misok by a neighbour.

He said police arrived about 11pm and found the victim to be heavily intoxicated.

Hours later, Misok went outside his house again and repeatedly yelled derogatory words at the neighbour’s house, disturbing others in the street.

Official complaints were made to police the following day and Misok was arrested a day later.

Misok is the fourth male The Morning Bulletin has heard the sentencing proceedings of in Rockhampton District Court where the child was mentioned as the victim in the past three months.

The first was the sentencing of father-of-nine John Francis Kerrigan, 81, in early October.

He was convicted of three counts of indecent treatment of a child under 16.

It was during the sentencing proceedings of the second man, Paul Hataihanua, 30, that Crown prosecutor Monique Bros-Wilshire told the court the girl’s name was in other files in the Department of Public Prosecutions office in Rockhampton.

Father of four and grandfather of eight, Anthony James Taylor, 78, was the third man and he was sentenced on December 16.

Misok, who is a Papua New Guinea national who moved to Australia on a temporary work visa in March 2021, pleaded guilty to one count each of rape, assault occasioning bodily harm, common assault, assault occasioning bodily harm while armed and public nuisance.

The court heard that according to Australian migration law, because Misok faced a sentence greater than 12 months, he was likely to be deported back to PNG once he is released from prison.

Ms Willey said the visa her client, who is an only child, was on was for three years meaning it expired in March 2024.

She said Misok’s mother died when he was 22 and his father died last year.

Ms Willey said he had already lost his job at the meatworks and had no accommodation or family in Australia.

Judge Clarke sentenced Misok to three years prison, suspended the sentence after 441 days and declared 441 days presentence custody as time already served with a five-year operational period.
