Lynton Lionet Leo sentenced in court for burglary and common assault

After hearing allegations of sexual misconduct, a man entered a unit at a Rockhampton motel and attacked another man. Here’s what happened.

A drug user gained entry to a unit at a Rockhampton motel by using a woman as a rouse and attacked a man after hearing allegations of sexual misconduct.

Lynton Lionet Leo, 27, pleaded guilty in Rockhampton District Court on June 22 to one count of burglary and common assault.

Crown prosecutor Matthew Sutton said the offending came about after a complaint of alleged sexual misconduct by the victim.

Mr Sutton said Leo’s sister had told him of that complaint.

Mr Sutton said after hearing the allegation, Leo attended the Centrepoint Motor Inn in Rockhampton on December 7, 2020, and about 1.30am an unknown female knocked on the victim’s motel door requesting to use the shower.

“This was a guise as the defendant was there,” Mr Sutton said.

“The defendant used that opportunity to force his way into the motel room.”

Mr Sutton said Leo yelled “you like raping little girls” before punching the man.

He said Leo repeated his statements and threatened to snap the man’s neck before eventually leaving.

Mr Sutton said the formal complaint of sexual misconduct was withdrawn in September 2021.

Judge Jeff Clarke described the offence as a “vigilante attack” on the man.

Defence barrister Maree Willey said her client went to the victim’s unit the day he heard his sister’s allegation and that the offence involved a single punch.

“There are no excuses for my client’s behaviour,” Ms Willey said.

“Upon receiving the information from his sister he saw red.”

Ms Willey said her client had a long-standing drug habit and started using methamphetamine at 14 years old.

She said her client was attending Drug ARM and stopped using drugs in May.

Judge Clarke sentenced Leo to 15 months’ prison with parole release set for November 22, 2022.

A seven-month suspended term of imprisonment Leo had received in August 2019 was activated.
