Lochlan James Thorn Inslay threatened to stab someone’s organs out before committing a vile act in a police cell

A Yeppoon teenager broke into a dead woman’s home and stole money, threatened to stab a man’s organs out, and smeared his own blood on the window and walls of a police cell.

Lochlan James Thorn Inslay, 18, pleaded guilty in Yeppoon Magistrates Court on June 30 to six charges.

They were entering the premises of a deceased estate with intent, stealing money from a deceased estate, two counts of wilful damage, public nuisance and breaching a bail condition.

Police prosecutor Sergeant Kevin Ongheen explained Thorn Inslay’s offending in date order.

Sgt Ongheen said that on May 4, Thorn Inslay went to a Rockhampton Road property - the house and its contents being that of a deceased estate.

“At the time of the offence, no person was residing at the premises,” Sgt Ongheen said.

The prosecutor said that about 12.15am, Thorn Inslay entered an enclosed patio area at the rear of the house through an unlocked screen door.

Sgt Ongheen said Thorn Inslay then used an unknown implement to force open a locked rear timber door, and while inside the house, he stole $5 from a cabinet.

Thorn Inslay also picked up a lamp and threw it at a rear door, putting a hole in it, Sgt Ongheen said.

Police also found a ceramic plate smashed on the floor.

Sgt Ongheen said a number of cabinets had been searched through inside the house.

The prosecutor said during forensic examination, Thorn Inslay’s fingerprints were found on the lamp and the rear door.

Sgt Ongheen said on May 11, at 1.27am, police were called to William Street, Yeppoon, in relation to a disturbance.

“A male (Thorn Inslay), not wearing a shirt, swearing, threatening violence and property damage,” Sgt Ongheen said.

The prosecutor said when police arrived, they saw people standing in the middle of William Street and a number of residents outside their homes looking at the disturbance.

Sgt Ongheen said a witness had asked Thorn Inslay to “move along” and Thorn Inslay made threats to bash the witness and said: “I’ll put you on your ar--, c---, I’ll stab your organs out.”

During questioning, Thorn Inslay told police he had consumed half a litre of bourbon that evening for his girlfriend’s birthday.

Sgt Ongheen said Thorn Inslay continued to swear and make threats to stab people while talking to police despite being warned numerous times not to do so.

Thorn Inslay was subsequently arrested and taken to Yeppoon police station where he was put in a holding cell.

“Whilst in the holding cell, he picked at scabs on his elbow making them bleed - he then smeared blood on the window and the walls of the holding cell leaving a stain,” Sgt Ongheen said.

“He was warned to stop... he then stood on a seat, looked into the CCTV monitoring camera and yelled ‘f--- up sl--.’

“He then spat on the camera, blurring the recorded image.”

Sgt Ongheen said police also found fresh spit marks on the window of the holding cell.

“(Thorn Inslay) continued to spit despite being told not to do so.”

The breach of bail offence happened on May 14 and related to Thorn Inslay not being at his bail address as required.

The court heard Thorn Inslay had no criminal history and Sgt Ongheen said: “Even though it’s first offending he seems to be a troubled young man possibly in need of probation and parole.”

The prosecution did not seek restitution in relation to any of the offences.

Solicitor Ashley Reynolds said Thorn Inslay’s mother was in court in support of him.

Ms Reynolds said Thorn Inslay, who was working fixing and selling lawn mowers, instructed he had ADHD, PTSD and struggled with anger.

The solicitor said Thorn Inslay had an upcoming medical appointment in relation to his issues.

Ms Reynolds said Thorn Inslay conceded his behaviour in the police cell “was gross”.

Before handing down penalty, Magistrate Cameron Press had some advice for Thorn Inslay.

“There’s a number of offences here and it just constitutes bad behaviour,” Mr Press said.

“These offences like this can land you going to jail, alright.

“You do not want to be going to jail at 18/19 years of age - you’ve got to work at getting your behaviour under control.

“You have every reason to do that in order to avoid jail, right.”

Mr Press placed Thorn Inslay on 12 months’ probation with conditions.

No convictions were recorded.
