Police chase through Gracemere backyards for alleged car thief

He is barely an adult, but one serial car thief who drove at a police car while intoxicated, twice kicked a policeman in the genitals, ran red lights and cut off a truck, is about to become a father.

Kyle Shane Drage, 18, pleaded guilty to 23 charges in Rockhampton Magistrates Court on December 13.

The charges included dangerous operation of a motor vehicle, drink driving, driving while State Penalty Enforcement Registry (SPER) suspended, evasion, stealing, unlawful use of motor vehicle, wilful damage, tattooing a minor, assault police and obstruct police.

Police prosecutor Clancy Fox said the most serious of the offending was the dangerous operation of a motor vehicle on Archer Street, Rockhampton, with a blood-alcohol content reading of .081, his licence suspended and evading police on November 28, 2021.

Defence lawyer Rebecca Winning said her client had drunk 12 heavy beers before getting into an argument with unknown neighbours.

She said one of the neighbours dropped car keys, Drage picked them up and took their car.

The court heard Drage drove through red lights at the George and Fitzroy Streets intersection, turning left and cutting off a truck, causing it to take evasive action to avoid a collision.

He then ran another red light at the Denham and Fitzroy streets intersection and again turned left in the intersection.

“There was danger caused to other road users,” Mr Fox said.

Police saw Drage driving on Archer Street, activated lights and sirens with Drage turning right, straight into the path of the police vehicle, causing the officers to fear for their safety as Drage swerved the car at them.

“There was also the intentional driving towards police causing them to take evasive action,” Mr Fox said.

“He continued to proceed through red lights, creating potentially dangerous situations for other road users.”

Drage then stole a Mitsubishi SX, stealing items from the vehicle including $20, passports, a baby seat and stroller.

He then stole an iPhone and headphones and crashed a car, causing damage to the back panel.

Drage then assaulted police by pushing them in the chest.

He started complying with police after a taser was drawn.

Two months earlier, police executed a search warrant on a Moura address with Drage running to the bathroom where his sister was showering and hiding in a cupboard.

Drage later moved to hide in the sofa with his mother sitting on top of him.

As Drage attempted to call his grandmother on his phone, police took the phone off him.

Then his mother passed Drage her phone behind her back which police noticed.

As police attempted to arrest Drage, he kicked one officer in the groin twice, causing swelling and pain.

He was ultimately apprehended on the kitchen floor, but not before he scratched on officer’s chest and ripped off their vest which contained their body worn camera.

Ms Winning said her client, whose pregnant partner was in court in his support, had been diagnosed with Attention Deficit Hyperactivity Disorder (ADHD) and had severe anger issues which were triggered by police due to childhood trauma.

She said he used to consume methamphetamines but quit cold turkey with the help of his partner, but still used marijuana occasionally.

Ms Winning said Drage had been homeless for a period.

She said with regards to the tattooing of a minor, Drage had purchased a tattoo gun and ink.

Ms Winning said he was at the skate park when he was approached by a 14 year old, who he thought was over 18, who asked him for a tattoo.

She said Drage did admit to police he was not aware it was illegal to give minors tattoos.

Magistrate Jason Schubert sentenced Drage to 12 months prison, declared 15 days presentence custody as time served and set parole release on February 27.

He also disqualified Drage from driving for three years and ordered him to pay fines totalling $900.
