Joel Gary Zemek, 30, pleaded guilty on November 23 in the Supreme Court in Rockhampton to two counts of possessing a dangerous drug in excess of two grams, two counts of supplying a dangerous drug and one of possessing a thing used in the commission of a crime.

Zemek was found with 5.6g pure meth in 11.4g of substance when first intercepted at 1.50am November 10, 2020, after the Holden Astra, in which he had been a passenger, was pulled over for a random breath test.

The court heard police had been called to reports a car had driven through and damaged a gate on Transport Avenue, Paget, in the Mackay area, on November 27, at 6.45am.

The car was later found in Amieth Street and police knocked on the door with Zemek turning to run away from police.

When he was captured, police found him holding a wallet tightly under his arm.

The wallet contained 4.1g of pure meth in 5.46g of substance.

He gave police one of his brothers’ names and police seized his mobile phone which contained messages about two drugs supplies – one for 0.2g and the other 0.1g.

The court heard that a conversation on November 25 with a buyer indicated they wanted to catch up with Zemek after the school run to obtain the drugs, however the sale took place the following day.

Zemek, who has a 16-page criminal record and eight page traffic record, was on a suspended sentence handed down on December 19, 2018 for a dangerous operation of a motor vehicle and other crimes, at the time of these offences.

The court heard Zemek was released from custody on June 25, 2020, with these offences taking place 4.5 months later.

Defence barrister Scott Lynch said Zemek, who had three brothers, was allegedly abused by a teacher when he was 11 or 12 and left school soon after, moved in with a friend and started using drugs.

He said Zemek had been fighting his drug addiction ever since, but had also managed to work as a labourer, in landscaping, at the meatworks and in cabinet making.

Mr Lynch said Zemek had a six-month-old child to his partner and had work lined up when he was released from prison.

He said Zemek had spent a significant amount of his life in prisons and was keen to move on from that lifestyle.

Justice Graeme Crow said Zemek was “plainly someone with significant drug problems” with his criminal and traffic records showing four convictions for dangerous operation of a motor vehicle, an assault occasioning bodily harm, enter premises and commit indictable offence, drink driving and drug driving.

“You are just a disaster waiting to happen when you are on drugs,” he said.

He ordered Zemek to a head sentence of three years prison with immediate parole eligibility, taking into account the parole board’s nine month delays and declared three days presentence custody.

Zemek has outstanding charges in the magistrates court jurisdiction.
