Jesse James Chilvers in Rockhampton court for assault occasioning bodily harm

A woman who had been assaulted by a man with a four-page criminal record thought her ordeal was over until he threatened to come back after the police had left.

A woman who had been assaulted by a man with a four-page criminal record thought her ordeal was over until he threatened to come back after the police had left.

Jesse James Chilvers, 25, assaulted the woman in the North Rockhampton suburb of Berserker on April 13.

Rockhampton Magistrates Court heard Chilvers grabbed the woman by the back of the neck, pushed her to the ground and kicked her in the ribs.

Acting Magistrate Paul Byrne said the woman “complained to Queensland Ambulance Service of significant pain in her ribs as a result of the single kick”.

Mr Byrne said Chilvers further slapped the woman to the side of the face and threatened to come back after the police had gone.

“In fact you did come back,” he said.

“You came back an hour later.”

Chilvers was also charged with obstructing a watchhouse officer that same day.

Defence lawyer Jess King said the injuries the victim suffered were limited to scratches to the victim’s forearms caused when she was pushed to the ground.

“There were fortunately no injuries whatsoever sustained as a result of the kick to the torso,” she said.

Ms King said the victim also didn’t sustain any injuries as a result of the slap to the face.

She said her client was not on any court orders at the time of the offending and that Mr Byrne would be able to set a parole release date on any term of imprisonment ordered.

Chilvers pleaded guilty to one count each of assault occasioning bodily harm and obstructing a watchhouse officer.

Mr Byrne sentenced Chilvers to 15 months prison, declared 96 days of presentence custody as time served and ordered he be released on parole on September 13.
