Gernita Alvina Creek smashed a woman’s home window with a rock and called her out to fight

Police received a Triple Zero call about the incident at Biloela and when they arrived, they saw the offender walking away from the scene. Here’s what happened.

A Biloela mother who threw a rock through a home window and called another woman out to fight, has faced court for her offending.

Gernita Alvina Creek, 30, pleaded guilty in Biloela Magistrates Court on June 8 to wilful damage.

Police prosecutor Stacey Bain said at 10.19am on February 14, police received a Triple Zero call advising that Creek had smashed a window of a Biloela residence in Neville Street with a rock and was calling a female out to fight.

Ms Bain said police attended and they saw Creek walking away from the residence.

The prosecutor said Creek told police she had attended the residence to sort out a disagreement with the woman but she denied smashing the window.

“Police spoke to the informant and witness who stated (Creek) picked up a rock from the front yard and threw it at the lounge room window, causing it to smash,” Ms Bain said.

As part of their investigations, police spoke to other people in relation to the incident and Creek was subsequently charged.

The prosecution sought $367.37 restitution on behalf of the Department of Housing for the damage to the window.

Solicitor Pierre Lammersdorf said Creek was a mother of four who had previously worked in retail and she was currently looking for employment.

Mr Lammersdorf said Creek was “ashamed and remorseful” for her actions and she had a limited criminal history.

“My client’s aware that she didn’t set a good example to her children who, whilst they weren’t physically present, would still be aware of the conduct of course,” Mr Lammersdorf said.

“And, Your Honour, she (Creek) was just annoyed in regards to some comments that were made by the other person.

“She didn’t even really know the other person all that well, and sadly made the decision to go over there, and it escalated to the point where she’s thrown the rock through the window.”

Mr Lammersdorf said alcohol was not involved.

Before handing down penalty, Magistrate Philippa Beckinsale had some advice for Creek.

“You do have to grow up and set that good example now,” Ms Beckinsale said.

Creek was fined $300 and ordered to pay $367.37 restitution.

No conviction was recorded.
