A bar manager has faced court for allowing someone else to grow cannabis on the veranda of his Capricorn Coast home.

Edward James O’Halloran, 51, pleaded guilty in Yeppoon Magistrates Court on December 16 to being the occupier of an address at Zilzie, permitting it to be used for the commission of a drug crime.

The prosecution told the court that on November 29, police executed a search warrant at a San Marino Way house at Zilzie.

O’Halloran was not present at the time.

Police officers found cannabis plants and utensils “in clear view” on the back veranda, the prosecution said.

On December 4, police again went to the house and they spoke to O’Halloran.

“The defendant stated to police under caution that he was aware that drug use was occurring at his residence and that he permitted the tenants at his residence to use drugs at that dwelling,” Police Prosecutor Darrell Dalton said.

“He was issued with a notice to appear (in court).”

The court heard that O’Halloran had no previous criminal history.

Solicitor Krissy Cummins said the tenants at the residence were O’Halloran’s ex-partner’s son and family.

Ms Cummins said O’Halloran had never used drugs himself and given he had no criminal history, she asked Magistrate Cameron Press to consider a good behaviour order.

Mr Press placed O’Halloran on a 12-month good behaviour order with a $500 recognisance.

No conviction was recorded.
