Bailey Stacpoole sentenced for police assault at Emu Park Oktoberfest

After a run-in with another Oktoberfest patron, a Central Queensland teenager turned his aggression towards police and it took multiple officers to arrest him.

A Central Queensland teenager who kicked a senior police officer in an ugly Oktoberfest incident, has been sentenced.

Bailey James Stacpoole, 19, pleaded guilty in Yeppoon Magistrates Court to public nuisance in the vicinity of licensed premises, obstructing police and assaulting police.

Police prosecutor Claudia Neill-Ballantine said on October 26, police were called to a disturbance involving Stacpoole and another male outside the front gate of Emu Park’s Oktoberfest.

After police spoke to both of them, officers left the scene.

But a short time later, police were called back there.

“Police observed (Stacpoole) attempting to violently assault (the other male),” Ms Neill-Ballantine said.

“Police had to physically restrain (Stacpoole) while informing him that he was under arrest.”

Ms Neill-Ballantine said Stacpoole attempted to “escape” police while yelling profanities towards the other male.

The prosecutor said Stacpoole had to be restrained by multiple police officers “even after being handcuffed.”

“During the struggling (Stacpoole) began kicking his legs out, subsequently kicking (a senior constable) in the left thigh.”

Ms Neill-Ballantine said Stacpoole continued to obstruct police.

The court heard that Stacpoole had no criminal history.

Solicitor Oscar Millroy said Stacpoole, a tyre fitter, was intoxicated on the day of the offending.

“He accepts the (police) facts but he became scared (on the day) and was struggling to breathe - he was nervous, he has a heart condition,” Mr Millroy said.

“And that may provide some explanation for his dramatic behaviour, not withstanding the offence.”

Mr Millroy said Stacpoole was a young man of good character who was “extremely remorseful” for his actions.

Magistrate Philippa Beckinsale ordered Stacpoole perform 80 hours of unpaid community service.

No convictions were recorded.
