Anthony Patrick Pianta had a blood-alcohol content reading of .053 when he was intercepted driving along Reaney Street, Rockhampton, on October 16 at 5.52pm.
Pianta, who worked as a builder on the Capricorn Coast, pleaded guilty in Rockhampton Magistrates Court on November 1 to the single drink-driving charge.
Police prosecutor Clancy Fox said Pianta told police he had been at the Caulfield Cup race day and had consumed three alcoholic drinks and was driving to Yeppoon to pick up his daughter from work.
Pianta handed Magistrate Philippa Beckinsale an application for a restricted work licence.
He said he was aware there was random breath testing outside Callaghan Park and that he only had a couple drinks.
“I had my last drink half an hour before I drove and was just over,” he said.
Ms Beckinsale granted Pianta a restricted work licence.
He was fined $350 and disqualified from driving for two months with a traffic conviction recorded.
