Alwyn Eltosn Blair to be sentenced for 10 stolen car offences

An accused serial car thief recently convicted for robbing a pub where he and a co-offender stole $2800 of alcohol and more than $2500 of cash is expected to be sentenced for 52 more charges.

An accused serial car thief recently convicted for a robbery of a pub where he and a co-offender stole $2800 of alcohol and more than $2500 of cash is expected to be sentenced for 52 more charges this Friday.

Alwyn Eltosn Blair, 19, was supposed to be sentenced for the 52 charges on December 5, however, his lawyer discovered a major issue with the charges at 2am that day.

Defence lawyer Pierre Lammersdorf told Magistrate Grace Kahlert he had recently taken the file over and only discovered the issue at 2am Monday.

He said one of the charges – the unlawful use of a motor vehicle intended for an indictable offence – was a charge that could not be dealt with in the magistrates’ jurisdiction.

“That is a charge that is strictly indictable,” Mr Lammersdorf said.

“I’ve no idea why it hasn’t been committed at the same time as the robbery.”

Blair was sentenced on November 29 and the stolen car was used in that robbery.

Mr Lammersdorf said he has already made submissions to police prosecutions regarding that charge after discovering it among the 52 outstanding charges.

“I’ve been doing this job for many years,” he said.

“I’ve never had this problem in my past.”

Two charges were dropped during the December 5 proceedings with alternative charges, that were listed with the now dropped ones, being opted for by both defence and police prosecution.

The court heard police prosecution had prepared a 42-page schedule of facts for the sentencing and Mr Lammersdorf’s submissions were equally long.

Magistrate Kahlert scheduled two hours for the sentence to proceed on December 16 at 10.30am, commenting she expected it to take 30 minutes to arraign Blair.

Blair was sentenced in the district court to three years’ prison, with 215 days pre-sentence custody declared as time served and parole release set for January 23, 2023.

One count of attempted entry of a dwelling with intent

Three counts of attempted to enter premises with intent to commit an indictable offence

One attempted unlawful use of a motor vehicle

One dangerous operation of a motor vehicle

Three driving without a licence

Ten enter dwellings and commit indictable offences

Nine counts of entering premises and committing indictable offences

One of entering premises by break and committing indictable offences

One possessing drug utensils

Two possessing illicit drugs

Three receive tainted property

Ten unlawful use of motor vehicles

One breach of bail

Two counts of entering a premise with the intent to commit indictable offences

One evade police

One wilful damage

One of possessing more than the prescribed amount of alcohol in a restricted area without a permit
