The case against a Central Queensland woman accused of killing her stepson will not reach the Supreme Court before the three year anniversary of the toddler’s death.

Alicia Jane Lee was charged with murder after the death of two-year-old Logan Shaun Hawkins in February, 2022.

Logan had died on January 19, 2022, the day after emergency services were called to a Frenchville address and he was rushed to Rockhampton Hospital, and then on to Queensland Children’s Hospital in Brisbane.

He died from a traumatic brain injury.

An update on the case was heard in Rockhampton Magistrates Court on August 21 where Ms Lee’s Legal Aid defence lawyer Natasha Bates advised that the long-awaited medical report from the Brisbane hospital doctor, who was the treating physician prior to turning off Logan’s life support, had been received and forwarded to the defence team’s own expert for an independent report.

“He has advised he should have the report available by early December,” Ms Bates said.

“In the interim, we have also notified police prosecutions of some outstanding materials in the index of the brief (of evidence) and that will not hold up the expert report.”

She said the defence may rely on its own expert report in the committal proceedings.

Police prosecutor Mirren Smith said her office had received the email from Ms Lee’s lawyers, which was quite lengthy, and there was “a lot to go through”.

The case was adjourned to September 18.

Ms Lee was not required to attend court this month and remains on Supreme Court bail, living in the Brisbane area.

During a bail application on August 12, 2022, Crown prosecutor Aleksandra Nikolic said significant force was required to have resulted in the injuries identified by the doctor.

She said it was alleged Ms Lee was the only adult with Logan at the time the fatal injuries were inflicted.

Ms Lee’s bail conditions include no contact with Crown witnesses and no contact with children under the age of 10 without supervision.

No plea has been entered.
