Max Russell Barker in Rockhampton court for multiple charges

A thick accent has allegedly linked a father of three charged with 35 counts of supplying drugs to break and enters and a torched car, a Rockhampton court has heard.

“A thick New Zealand accent” on a phone video and CCTV footage supplied by a railway company make up evidence police allege links an unemployed father of three to break and enters and a torched car.

This is what Rockhampton Magistrates Court heard during a bail application for Max Russell Barker, 28, who was charged with 47 offences including 35 counts of supplying drugs, three counts of possessing drugs, one of arson (car), one of unlawful use of a motor vehicle and one of entering premises and committing an indictable offence.

Mr Barker, who was born in New Zealand, was on bail at the time, charged with one count possessing more than two grams of a schedule one drug and one count of receiving tainted property, the court heard.

Defence lawyer Grant Cagney said the enter premises of Aurizon seem to rely on CCTV cameras depicting Mr Barker entering or exiting vehicles that are relevant to the investigation at the time.

“For the charge of arson, it is conceded by police the footage that they have does not depict my client lighting the car on fire and the identification of my client seems to be another circumstantial case based on the fact that video was found on his phone.

“And secondly, that voice can be heard saying ‘centred’ in a thick New Zealand accent.”

The court heard the alleged supply drug charges arose from messages found on Mr Barker’s phone.

Mr Cagney argued keeping Mr Barker remanded in custody was not justified due to his criminal history having only been fined or placed on probation in the past and the evidence in some charges being “relatively circumstantial”.

Police prosecutor Sergeant David Longhurst raised concerns Mr Barker would commit further offences if granted bail as it was alleged he committed these 47 offences while on bail.

“There’s a pretty logical inference that it’s all related to (alleged) drug offending, to access money or to pay off debts,” he said.

Sergeant Longhurst said whether or not Mr Barker is convicted for the arson, or being a party to the arson, he still faced a long period of prison for the alleged drug offences.

Acting magistrate Paul Byrne said from his experience, Mr Barker could be indicted for trafficking drugs due to the number of supply charges currently before the court.

He said a lot of the evidence came from CCTV of the premises where he was living at the time and stolen property was found at his residence.

Mr Barker’s bail was denied and he was remanded in custody.

Briefs of evidence were ordered for the drug supplies and arson charges and his charges were adjourned until August 2.
