A handful of houses, including a unit with ocean views, are set to go to unpaid rates auction by Livingstone Shire Council later this month.
A formal notice was published by the council on March 13 for four properties with unpaid rates.
Under Local Government Regulation 2012, council is authorised to sell land if the rates or charges have been overdue for at least three years, or one year for vacant or commercial land.
The land is to be sold at market or land value or higher than the amount of the overdue rates/charges.
A list of 18 properties for auction were presented to council on September 20, 2022, and a number of owners have since paid the outstanding amounts.
The remaining property owners were sent a Notice of Intention to Sell on November 7 and the auction will proceed unless all overdue rates, interest and other amounts are paid.
“Ratepayers always have the options to enter into formal payment arrangements which prevents legal action being progressed by council’s debt collection agency,” a council report starts.
Council charges a rate of seven per cent per annum on overdue rates and utility charges, applied monthly on all overdue balances.
As of February 2023, 424 properties were under management totalling a sum of $1,701,841 with 269 under debt collection, 52 under proposals to pay, 101 under agreements to pay and two under council hardship.
Livingstone Shire Council has 18,098 rateable properties with 424 under management representing 2.3 per cent.
