As his terrified partner drove, Kywin Glen John Mitchell climbed from the front passenger seat and began strangling her before later wrapping a seatbelt around her neck.

This was just four days after he’d warned if he “could not have her, no-one else could”.

Crown Prosecutor Luke Smoothy told Rockhampton District Court it was “chilling to think” how the victim must have felt while being strangled so soon after she was told by Mitchell that he’d “kill her”.

Disturbing details about the meth using serial criminal turned domestic violence monster were read out in the court which heard he’d previously been convicted of stealing $72,000 cash from a hotel manager as they exited the bank in Moranbah when he was 19 years old.

He also had convictions for grievous bodily harm over a 2016 jail assault, arranging for a restricted drug to be smuggled into jail and also, a home invasion in Bowen in 2017 where he kicked and stomped on a woman’s face.

Judge Jeff Clarke said Mitchell had only been out of custody three short periods of seven months and eight months since 2014.

The recent sentencing stemmed from events in January, 2022, when Mitchell accused his partner of sleeping with other men and punched her in the chest.

In a series of protracted violent incidents, Mitchell repeatedly accused of her infidelity, threw her up against furniture and walls, punched her in the chest and face and squeezed her throat.

The father-of-three from Cloncurry threatened to kill himself and the victim, while driving out to bushland and threatening to wrap an extension cord around her neck and drag her behind the vehicle.

“He told her if he could not have her, no one else could,” Mr Smoothy said.

“He pulled over into some bushland and told her to get out of the car, pulled her hair, hit her multiple times.”

On another drive at Norman Gardens, he used his hands to squeeze her throat from behind while she was driving.

She slammed on the brakes and stopped in the middle of the road.

When they arrived at the destination, Mitchell used the seatbelt to strangle her while she was still in the driver’s seat.

He pleaded guilty to two counts of choking/strangulation (domestic violence), three of assault occasioning bodily harm (domestic violence), and three common assaults.

Defence barrister Maree Willey said her client started using marijuana and drinking alcohol when he was 11 and moved on to methamphetamines a few years ago.

He said Mitchell was voluntarily intoxicated by drugs at the time he committed these offences.

“(I’m) simply lost for words that you could have treated another person in such a thoroughly violent way for such a long period of time,” Judge Clarke said.

He sentenced Mitchell to three years prison with parole eligibility from June 20, 2024.
