A father of five “is aware that he did not set a good example for his little ones” when he assaulted a takeaway shop worker. The man had a five page criminal record, the court heard.

A father of five “is aware that he did not set a good example for his little ones” when he assaulted a takeaway shop owner over 60, a court has heard.

Jacob Loyd Duncan Weazel, 32, fronted Rockhampton Magistrates Court on May 15 over the violent incident.

Police prosecutor Corey O’Connor said Weazel attended the Dean Street, Frenchville, takeaway shop about 10.20am on March 23, 2024, and had a verbal argument with the victim – a man aged over 60.

He said Weazel knocked a bucket of tickets off the counter while continuing the argument as he left the shop, picked up a chair and threw it at the victim, hitting and causing a cut, which bled.

“This was captured on CCTV,” Mr O’Connor said.

He said Weazel had a five-page criminal record.

Defence lawyer Pierre Lammersdorf said his client, who has five children aged between two to 10, had a disagreement with the shop owner and “took it too far”.

“He was remorseful as soon as he picked it up,” he said.

“He is also aware that it did not set a good example for his little ones.”

Mr Lammersdorf said Weazel works full time for a painting and decorating business and offered to pay $500 compensation.

Magistrate Philippa Beckinsale said Weazel needed to set a better example for his children who were “very young and very impressionable”.

Weazel pleaded guilty to one count of assault a person aged over 60 and was ordered to 12 months probation and pay $500 compensation.

A conviction was recorded.
