A GOLD Coast nurse who claims she had to have a hip replacement after slipping on a grape while grocery shopping is suing a major supermarket chain for more than $1.3 million.
Charlotte Louise Bobbett, 43, was walking in the fruit and vegetable section of Woolworths supermarket at Pacific Pines in December, 2015, when she stood on the grape, her claim says.
Ms Bobbett, then 38, slipped and fell to the ground, suffering a right hip injury and later had to have a hip replacement, the claim says.
She also allegedly suffered injuries to her right shoulder and lower back.
Ms Bobbett, a registered enrolled nurse, has been unable to complete her Bachelor of Nursing degree since the accident, because of her physical injuries and the psychological impact, it is alleged.
The accident happened at 3pm, on December 22, 2015.
Woolworths ought to have known that in the weeks prior to Christmas there would have been increased pedestrian traffic in the supermarket, and increased risk of injury if there was inadequate cleaning, it is alleged.
The supermarket failed to have an adequate system for regular inspecting the fruit and vegetable department to identify hazards that posed a risk of injury to customers, the claim says.
It also alleges the supermarket failed to place non-slip matting on the floor of the fruit and vegetable section.
Ms Bobbett was diagnosed with an adjustment disorder with anxious mood after the accident.
It is claimed Ms Bobbett has been unable to work in nursing or obtain alternative work for which she is vocationally trained or experienced, because of her injuries.
She is suing Woolworths Group Limited for $1,300,278.
Ms Bobbett’s claim includes $100,000 for past economic loss, $750,000 for future economic loss and $40,000 for future surgical expenses, including a revision total hip replacement.
Woolworths is yet to respond to the claim for damages for alleged negligence or breach of contract, which was filed in the Supreme Court in Brisbane on September 24.
