Noosa Council takes legal action against Kin Kin Quarry operator Cordwell Resources over alleged breaches

The Noosa Council is taking a quarry operator to court over allegations inappropriate truck movements to and from the site had breached development approval.

Noosa Council is taking legal action against Kin Kin Quarry operator Cordwell Resources over alleged breaches and inappropriate quarry truck movements impacting the hinterland community.

The council filed its case with the Land and Environment Court seeking interim enforcement orders for all quarry truck movements to cease during school bus hours from the Sheppersons Lane quarry.

Court documents state the council also alleged Cordwell Resources breached the number of traffic movements approved by the council in the original development application.

The quarry operator also allegedly failed to prevent quarry trucks from hauling uncovered loads, operating outside of approved hours and an increase in trucks operating contrary to approvals by council.

The court case comes after ongoing community campaigning from residents wanting the quarry operators to be held accountable.

Council CEO Brett de Chastel said further proceedings would focus on a number of alleged breaches by the quarry operator and seeks to address the intensification of use issues, which is at the centre of community concern.

“Final enforcement orders will be sought requiring the operators to limit the number of quarry trucks per day, avoid convoying and ensure movements are within the operating hours, with all truck loads covered,” Mr de Chastel said.

Mayor Clare Stewart said more than 20 Kin Kin and Pomona residents had provided statements to council which will be used as part of its legal case against the quarry operator.

“We have certainly put our money where our mouth is. The Noosa Council said it would stand with and behind the hinterland community,” she said.

“We are absolutely determined to fight this to the end.

“We have seen and we have heard the impact the quarry has had on our residents … and this is the most progressive and most aggressive step we can take.”

A directions hearing will be heard in Maroochydore Planning and Environment Court on Friday, September 24.

Council has invited residents to attend a community meeting at the Majestic Hall, Pomona, on Thursday, September 23, to discuss the case.

The case was filed last Friday, September 17.
