The case against a Mackay region “gym bro” accused of rape and stalking had been pushed out until at least February over delays relating to a sexual assault investigation kit.
Campwin Beach man Zak Jordan Winsley remains in custody on remand after his bail was rejected in October and appeared in Mackay Magistrates Court on Wednesday via video link.
The 24 year old is facing a raft of serious charges including rape, stalking, and illegally taking and sending explicit images.
He is charged with stalking between June and July 2023, a rape charge on November 16, 2023, making observations or recordings of the genital or anal region in breach of privacy at Campwin Beach on October 26, 2023 and distributing intimate images on January 20, 2024.
Legal Aid Queensland solicitor Rosie Varley said in relation to the rape charge, matters had been adjourned for prosecution to give an update on when they expected to disclose the outstanding evidence.
“There’s still outstanding evidence in regards to a sexual assault investigation kit,” Ms Varley said.
Prosecutor Leonie Taufa’ao handed up a document explaining the analysis was not expected to be done until late January 2025, to which Magistrate Bronwyn Hartigan said, “There’s not much we can do about that.”
The court heard once the analysis was completed Ms Varley would need time to consider the information and speak with her client.
“The sexual assault investigation kit which may or may not contain any DNA … it’s still under analysis and it takes time,” Ms Hartigan said.
“But it’s due, doing the best they can, police say January 31.
“I can’t do anything about it. The delay is the delay.”
As a result Ms Hartigan extended the deadline for the police brief of evidence until January 2025 and the case will be mentioned again in February.
Mr Winsley’s appearance will be excused at the next date.
