A Mackay meth user who breached multiple suspended sentences with the same type of drug offending has avoided going to jail.
Police found an amount of meth on Wayne Keith George Haupt during a pat down search at a Mackay region home on April 24, 2022.
Magistrate Bronwyn Hartigan said it was not a small amount of drugs – he was busted with 1.4g of meth gross weight and a pipe.
“We’re not talking about a couple of points – 1.4g even gross is a lot of methylamphetamines,” she said.
Ms Hartigan accepted the drugs were for personal use.
Haupt pleaded guilty to possessing dangerous drugs and a used drug utensil.
Defence solicitor Sean Gibbs, of Fisher Dore Lawyers, said his client was a fully qualified diesel fitter and was currently working but in a different role.
The court heard at the time of the offending he had not been working and had fallen back into drug use.
Haupt had previously spent some time in custody.
Mr Gibbs said his client had taken steps in the right direction.
Ms Hartigan accepted Haupt had previously proven he could stop using drugs, but said his criminal history was littered with drug-related offences that was consistent with drug use struggles.
“I have taken into account that you were on a suspended sentence for drugs at the time,” Ms Hartigan said, adding it had been multiple suspended jail terms.
“There is an ongoing nature of your drug offending.”
The court heard he had previously gotten through a parole order with no issues and Ms Hartigan said it was in Haupt’s interest that he remain in the community.
He was jailed for four months, cumulative with the activation of one month of a suspended sentence.
But for the five month total he was granted immediate parole. Convictions were recorded.
