A 27-year-old man walked out of a bar to help a drunk partygoer but ended up punching them in the face instead, Mackay Magistrates Court heard.
Tyrell Roydan Corey Mason joined family and friends at the Rabbit Hole in Mackay just after 11.40pm on November 30, 2024.
Another patron became intoxicated and was removed by security and Mason, who was also drunk, went outside with good intentions but ended up hitting him.
The court heard the victim then went rigid and fell to the ground, hitting his head on a tiled area and becoming unconscious.
Police arrived to find the victim with blood coming from his nose and unable to be woken when Mason approached them and said he’d hit the victim.
ATSILS solicitor Sarah Reid told the court the victim palmed Mason’s face which led to Mason punching him.
Mason pleaded guilty to assault occasioning bodily harm in public while adversely affected by intoxicating substance and police prosecutor Cora Kay said Mason was intoxicated and slurring.
Magistrate Damien Dwyer asked what injuries the victim received and Ms Kay said he was unconscious for a period of time and suffered a bump on the head and she was waiting on a report from the Mackay Hospital.
She said Mason was diagnosed with ADHD, depression and anxiety and was on medications at the time of the assault including Valium and said it was out of character for him to drink.
“My client was remorseful, he was scared for the victim,” Ms Reid said.
Mr Dwyer said Mason was a man of good character who reacted after being palmed to the face and “just taken it too far”.
“You went up to him with good intent,” Mr Dwyer said.
“He was assisting this gentleman when he got palmed to the face and he’s reacted.
“After that he was very remorseful.”
Mason was sentenced to serve 200 hours of community service to be completed within 12 months and was barred from entering any licensed venues in the Mackay safe night precinct until August 6, 2025.
No convictions were recorded.
