A rugby league legend will be questioned during a committal hearing for the man accused of trying to run the former origin great down on his own property.
Mackay Regional Councillor Marty Bella will be among five witnesses called to give evidence during a one-day hearing in Mackay Magistrates Court.
Samuel Anthony Camilleri, 55, is charged with dangerous driving on Schirmers Road and assault occasioning bodily harm while armed against Mr Bella on July 15, 2021.
He has pleaded not guilty to the dangerous driving charge and no plea has been entered for the assault while armed charge.
Police allege there was a verbal altercation before Mr Camilleri deliberately drove his ute at the former star prop, who was on a quad bike.
It is alleged this occurred when Mr Bella came across him on a newly bought property, 60km south of Mackay.
Police further allege Mr Camilleri then sprayed a substance in Mr Bella’s eyes several times before further assaulting him.
The case was briefly mentioned in Mackay Magistrates Court on Friday when Sergeant Paul Cramp said prosecution had initially opposed the cross examination, but now consented to the legal procedure.
The court heard the witnesses also included police officers and a doctor.
Fisher Dore solicitor Antoinette Morton, for Mr Camilleri, said the cross examination was likely to take the best part of a day.
The cross examination was tentatively listed for July.
Mr Camilleri did not appear in court for this mention.
