A homeless pregnant mum has been blasted over a violent home invasion against a sex worker she had once contacted about her services.

The 25 year old cried in Mackay District Court as her shameful conduct was read aloud.

Sahriab Kubi Ann Day-Nawakie had never met the 49-year-old victim but she or her partner had reached out to her in January 2020 over text message about engaging her services.

As a result the victim shared her address.

Crown prosecutor Lara Soldi said about six months later the victim was doing repairs to the patio of her home when Day-Nawakie entered her house “as part of her premeditated plan to steal from (her)”.

The court heard Day-Nawakie mentioned a mutual friend and said her phone had no battery and she needed to make a phone call.

Ms Soldi said Day-Nawakie followed the victim into her home, refused to give her name, rummaged through her handbag and rang another person speaking in “code” to say: I’m ready.

The court heard a second person had been pre arranged to come to the address, making her offending more serious.

The victim tried to push Day-Nawakie out her home to which she shoved the woman back inside and up against a wall, causing the victim to hurt her wrist and ankle.

“She was terrified,” Ms Soldi said, adding Day-Nawakie stole $1800 from a drawer in the victim’s home and left with the other person.

She pleaded guilty to burglary and stealing, and common assault carried out on June 29, 2020, after the matter had initially been listed for trial.

The court heard she was currently in custody on unrelated matters and had been on probation when she committed the home invasion.

Defence barrister Scott McLennan said his client was “raised in a house with a monster” and traumatised by domestic violence and abuse.

“She’s never engaged properly with psychological or psychiatric treatment,” Mr McLennan said.

“She’s still young and in my submission your honour could look at imposing a sentence which focuses on rehabilitation.”

But Judge Jennifer Rosengren said there were factors to be considered including Day-Nawakie’s conduct, which “was quite frankly appalling”.

“There was a serious element of premeditation and she effectively tricked this lady into going into her house and then treated her like that and stole her money and left,” Judge Rosengren said.

Mr McLennan told the court his client was a young mother, who had found herself homeless and was living “under severe financial stress for a number of years”.

“She was living in a shed … she found herself pregnant again and indeed she was quite desperate,” Mr McLennan said, adding this gave some context.

Judge Rosengren said she accepted there was no plan to inflict violence.

“You’ve actually entered her home at night and you have used violence,” Judge Rosengren said.

“When you have home invasions … at the end of the day general deterrence must be of paramount consideration.

“People who are in their homes do not deserve to have people like you breach the sanctity of their homes.”

Day-Nawakie was jailed for 18 months with immediate parole. Convictions were recorded.
