QLD man accused of rape, pleads guilty to domestic violence charges

An accused rapist crafted a chilling poem sent to his former partner that began with “1, 2 I’m coming for you” as part of a horrifying domestic violence spray following their break-up.
The father, who cannot be named for legal reasons, also threatened to slit a man’s throat in front of his children after he was unable to track down the terrified woman.
His ‘disgraceful’ offending occurred multiple times in the second half of 2021 when the pair lived at a Central Queensland mining town west of Mackay.
The details of his vile conduct was laid bare in Mackay Magistrates Court, which included numerous abusive and degrading messages and phone calls.
One of the messages included a chilling poem that read “1, 2 I’m coming for you; 3, 4 better lock your door; 5, 6 better run quick”.
He also called pretending to be another person and later made a threat that left her under the impression he planned to post nude photos of her on social media.
The court heard the woman, who shared a child with the man, was scared and distressed and made a complaint to police.
Officers searched his home and went through a number of electronic items.
The court heard he also tried to hide a mobile phone in his underwear before he handed it over to police – checks revealed he had sent a message to the woman “call the cops and withdraw the statement now”.
Later that year he went to the home of a man who knew the victim chasing information on her whereabouts.
When the man was unable to provide any information, he threatened to “smash” the man before saying “I’ll slit your throat c--t … I’ll slit your throat in front of your kids”.
The court heard this happened about 30 minutes after an argument with the woman about wanting her to bring their child to his home.
He pleaded guilty via video link to a number of charges including threatening violence, threats to distribute intimate images and multiple counts of breaching a domestic violence order.
Solicitor Fleur Cardell, of McKays Solicitors, said she was instructed the pair had met about six years ago and had a child, but the relationship turned sour about two years ago because of “infidelity by the aggrieved” and they separated.
“And the arguments began regarding visitation,” Ms Cardell said, adding the woman had left town and her client did not know the location of his child.
“I’m instructed there are cross protection orders in place.”
Ms Cardell said her client accepted his behaviour “would have been distressing” and told the court he never intended to carry out any threats.
The court heard the man was also on bail for a rape charge that will need to be committed to the district court.
Ms Cardell argued a fine or community-based order was in range for the offences, but said her client’s matters were complicated because he had spent 249 days in custody.
The court heard while in custody the man had undertaken courses and was “in a much better headspace”.
“It would be my submission (for) convicting and not further punishing (the man),” she said.
Magistrate Damien Dwyer said “that simply will never happen”.
“It was just grubby tactics on your behalf,” Mr Dwyer directed at the man over his conduct.
“It was disgraceful.
“It was terrible and it was persistent.”
Mr Dwyer acknowledged the man had already served the equivalent of a two-year jail term in custody on remand and placed him on 12 months probation.
