The case against a Whitsunday man accused of lighting a blaze near Cedar Creek Falls in an incident where police were forced to fire shots can proceed now that a “fitness” assessment has been finalised.

Paul Michael Lamborne is facing a number of charges including setting fire to crops, endangering particular property by fire, malicious act with intent and possessing dangerous drugs following an arrest in September 2019.

It is alleged police were called to Conway Rd, Palm Grove when a helicopter pilot reportedly saw a man lighting fires near Cedar Creek Falls.

It is also alleged police fired shots during the incident.

Mr Lamborne has been formally charged in the district court but the case was suspended.

The case was briefly mentioned in Mackay Magistrates Court as he still has charges in that jurisdiction.

The court heard the “fitness” test has since been completed and Mr Lamborne’s matters could now be completed in the higher court.

Matters have been adjourned to a later date.
