A young Queensland man convicted for sexually interfering with a teen girl has returned to court for abusing the same victim just nine weeks after he was released from custody.

A young Mackay man convicted for sexually interfering with a teen girl was back in court for abusing the same victim nine weeks after he was released from custody.

The 21 year old was given a partly suspended jail term for unlawful carnal knowledge with an underage teen.

But he was recently back before Mackay District Court for indecent treatment against the same 15-year-old child.

The court heard he had arranged to meet the teen one afternoon where he touched her inappropriately. He also sent text messages professing his love for her.

Crown prosecutor Samantha O’Rourke said the man, who cannot be named as it would identify the child, had a very relevant criminal history and committed the offending against the same victim nine weeks after his release from jail.

He pleaded guilty to 11 charges including indecent treatment of a child under 16, failing to comply with reporting conditions as a convicted child sex offender and aggravated breaches of a domestic violent order.

The court heard the DVO breach related to a different girl – he also professed his love for her before calling her names.

The court heard the man’s performance with community corrections in relation to probation was “concerning” – he was disengaged and did not complete a required sex offenders program.

He has been in custody since September 2020, totalling about 10 months.

The court heard he had a mental impairment, which Judge Julie Dick accepted.

“He’s got problems but I don’t know what to do to rehabilitate him,” Judge Dick said, adding he did not engage with probation.

Defence barrister Scott McLennan said his client had completed a course dealing with domestic violence.

He had left school in Year 8 and was working to complete Year 10 equivalency.

“You really boxed yourself into a difficult position,” Judge Dick told the man.

The court heard he had borderline personality disorder and issues with relationships linked to a fear of being abandoned.

Judge Dick advised him to see a GP to get a mental health plan.

“I think that your moral culpability is reduced,” Judge Dick said.

He was jailed for 18 months with immediate parole eligibility and because of the delays with the parole board this will not be heard until early 2022. Convictions were recorded.
