A Sarina mother of six has become her own jailer after she was handed a wholly suspended prison term for supplying marijuana.

Kylie Maree Louise Dudgeon was busted with drugs and utensils after police executed search warrants in April and July 2020.

Crown legal officer Emily Thambyah said during the later raid Dudgeon was also found possessing $8605 cash.

Mackay District Court heard she initially told police it was her and her partner’s savings and some leftover inheritance from her mother, before admitting it was proceeds of drug supplies.

Police also found tick sheets with handwritten names and amounts.

Ms Thambyah said Dudgeon told police she sold marijuana three times when she was “strapped for cash”.

Ms Thambyah said it could be inferred Dudgeon, then 45 years old, had been supplying in larger amounts.

Now 46, she pleaded guilty to eight charges including supplying and possessing dangerous drugs and possessing drug utensils and cash.

The court heard she smoked drugs for pain relief and became known as someone who had marijuana.

Defence barrister Paul Rutledge, instructed by Barron and Allen Lawyers, said Dudgeon was a mother of six.

“She’s ashamed of what she’s done,” Mr Rutledge said, adding his client’s own words were, “I’ve let my children down”.

The court heard she turned to marijuana after her mother’s death and was also taking medication for anxiety.

Mr Rutledge said Dudgeon and her family had been homeless before they secured a home at Sarina.

The court heard she had engaged with Lives Lived Well, which was a “very good experience for her” and had not taken any drugs for about six months as demonstrated by a number of negative test results tendered in court.

Mr Rutledge said Dudgeon had “very good prospects of rehabilitation” and Judge Ian Dearden agreed, finding “quite clearly a wholly suspended sentence is appropriate”.

The court heard the supply charges came through her own admissions to police, which Judge Dearden said also deserved special consideration.

Dudgeon was jailed for 12 months, wholly suspended for an operational period of 15 months.

“What I’m doing … is trusting you to be your own supervisor,” Judge Dearden said.

Convictions were recorded.
