A Mackay father pointed a loaded shotgun at his mother, yelling he would “blow her f**king head off” — all in front of his four-year-old daughter.
Mackay Magistrates Court heard the 38-year-old man had lived with his parents his entire life, but he was subject to a domestic violence order dictating he needed prior written consent to enter the home.
On June 5, the former miner began arguing with his mother when she asked him to leave.
The man refused, yelling at her it was “Dad’s house”.
His mother left the room to comfort his four-year-old daughter who was crying in the hallway while the man continued to pace and yell “you f**king want to start me”, throwing property around.
The former miner then stood in the doorway in front of his daughter, reaching into his wardrobe to pull out a “one and half metre” firearm.
The court heard he “pointed the muzzle directly at his mother” and said “I’m going to blow your f**king head off”, all in front of his four-year-old child.
Police were called to the home and a search found 2.742 grams of methamphetamine with more of the drug in a syringe, digital scales, $460 and ammunition.
The 38-year-old man was initially charged with conduct of a dangerous weapon which he had pleaded not guilty to, but during his trial the prosecution offered no evidence for it and the charge was dropped.
He pleaded guilty on November 1 to contravention of a domestic violence order, possession of a dangerous weapon, possession of methamphetamine and possession of explosives.
Magistrate Bronwyn Hartigan told the man the experience would have been “terrifying” for his daughter, particularly given his parents had cared for her since she was born.
The man gave the court no excuse for his actions but said his behaviour was uncharacteristic.
He was sentenced to 12 months jail for the breach of a domestic violence order and possession of methamphetamine, with an immediate parole release.
For the remaining charges, he was convicted and not further punished. The $460 was forfeited.
