Ashley Robinson charged over false worker’s compensation claim

A warrant has been issued for a Central Queensland tradie who allegedly twice lied to a doctor in relation to a worker’s compensation claim.

A warrant has been issued for a Whitsunday tradie charged over allegedly twice lying to a doctor about an injury linked to a worker’s comp claim.

Ashley Robinson is facing two counts of knowingly make a false declaration or misleading statement to an authority, workcover or self insurer.

It is alleged the incidents occurred on June 10 and July 23 in 2019 in Mackay.

It is alleged each time Mr Robinson “knowingly” gave a Mackay orthopaedic surgeon information that “was false or misleading” for the purpose of an application for compensation.

Court files viewed by this publication stated on June 6, 2019 Mr Robinson injured his shoulder while working as a rigger/trades assistant for UGL Operations and Maintenance (Services) Pty Ltd.

The injuries included rupturing his right biceps tendon and tearing his subscapularis muscle and tendon.

The following day, on June 7, Mr Robinson made a claim to WorkCover Queensland that was accepted and he was paid compensation from June 6 to December 2, 2019, the court file stated.

On June 10 Mr Robinson went to Dr Ulrich Dorgeloh as part of his workers’ comp claim and it is alleged that during the consultation he told the Mackay orthopaedic surgeon “he had not previously had any problems in his shoulder”.

It is alleged this statement was “false or misleading and (Mr Robinson) knew it was false or misleading because he had a significant history of injury to his right shoulder for which he had sought treatment”.

It is alleged he made the same statement on July 23.

It is alleged the information was false or misleading as the “truth about (his) history is relevant to the opinion and treatment plans of registered person and to the proper management and assessment of (his) claim for compensation”.

Mr Robinson is also facing three counts of the same charges in Rockhampton – it is alleged the offending occurred on July 23, October 10 and October 31, 2019, and a further charge of defraud or attempt to defraud an insurer on June 6, 2019, also in Rockhampton.

The Mackay matters were last mentioned in Mackay Magistrates Court on October 18 before being transferred to Rockhampton Magistrates Court to marry up with the other charges.

The case was listed for mention on October 25, however Mr Robinson failed to appear and a warrant was issued.
