AN ALLEGED Bandido associate, accused of being involved in the Broadbeach brawl, has asked a court to let him spend time with his Warwick father over Christmas.

AN ALLEGED Bandido associate, accused of being involved in the Broadbeach brawl that sparked a bikie crackdown across Queensland, has asked a court to let him spend time with his Warwick father over Christmas.

Brisbane Supreme Court heard Mathew Peter Cross, 27, had a bail condition about associating with bikies that potentially included his father Darrell Vincent Cross and his landlord.

Cross Snr has previously spent time behind bars, related to his association with the Bandidos bikie gang, for mowing down a traffic cop on a Bandidos president's Harley Davidson.

The court heard on Thursday that Cross Jnr believed a bail variation was needed in case new legislation about bikie associations covered family members.

Justice Peter Applegarth said the Crown did not argue the variation was necessary because neither of the men were actual gang members.

But he said "for clarity's purpose" he would vary the bail "so as not to prevent" Cross Jnr from associating with his father and his landlord.

Justice Applegarth said if they did become Bandidos bikie gang members in the future then the words excepting the two men could be deleted.

Cross Jnr is charged with rioting on September 27 and is due to appear in Southport Magistrates Court on the Gold Coast on December 6.

Police have arrested almost 400 criminal gang members in the crackdown and charged them with 817 offences.

But only 10 have been charged under the new anti-bikie laws and amendments passed in the past two months to help police with the crackdown.
