A DAD of six who performed an unwelcome sex act on a woman that he picked up when she was walking to a train station has been convicted of rape.

An Ipswich court heard the victim and the offender were complete strangers when he offered her a lift on the night of the offence.

Minutes later, they had consensual sex on the back seat, but when Tim Peter Chapman began another sex act on her she resisted, Ipswich District Court heard at his sentence.

Tim Peter Chapman, 38, from Leichhardt, pleaded guilty to one count of committing rape on January 19, 2019.

Prosecutor Amanda Robinson said the Crown would not proceed with a second rape charge, and Judge Alexander Horneman-Wren SC formally discharged Chapman on that charge.

Ms Robinson said they were strangers to each other when Chapman saw the woman walking and pulled over.

They had a conversation and then had consensual sex in the vehicle.

When Chapman afterwards began another sexual act the woman pushed him away but he engaged in the conduct for between one and two minutes.

Ms Robinson said Chapman told police he had the belief at the time the woman was consenting to the act.

He was later charged and spent 50 days in jail before being granted bail.

Defence barrister Scott Lynch said Chapman was engaged to be married to his long-term partner and was the father of six children.

He said Chapman was a talented sportsman, horseman and horse breaker, who had represented Australia in boxing including matches in Russia and Fiji.

Judge Horneman-Wren said the charge arose from "strange circumstances".

"They were two strangers and seemingly within minutes of meeting were having sexual intercourse in the back of a car," he said.

"The rape being the absence of consent with penile penetration of her mouth. Is really quite unique."

Judge Horneman-Wren said the matter had been listed for trial but was resolved on the basis of a plea on one count of rape with the other charge not proceeded with by the Crown.

"The highly unusual, exceptional circumstances by which your mistaken belief was found having been this episode of consensual sex between strangers," he said.

"There is nothing to suggest you are at risk of further offending of this kind.

"It must be said the circumstances are highly exceptional and unusual and demonstrate the need for general deterrence."

Judge Horneman-Wren said the case demonstrated the need that in any sexual encounter between people there must be consent given to all sexual acts.

Chapman was convicted and sentenced to a 2 ½-year jail term, suspended for three years after serving 50 days, which he had already served between April 9 and May 28 2019.

He was able to walk from the courtroom.
