Queensland Police Commissioner's message to victims of crime

A 74-year-old man accused of stabbing a woman in Redbank Plains in 2020 remains in custody two years later, waiting for his court date.

Bellbird Park man Jose Garcia, 74, stands charged with attempted murder and two counts of common assault.

The charges relate to an incident in March 2020, in which Garcia allegedly stabbed his 29-year-old neighbour late one evening in a Redbank Plains apartment building.

He was taken into custody in 2020, and still remains in custody today at Woodford Correctional Centre, according to Queensland Correctional Services.

His matter was mentioned in Ipswich Magistrates Court on September 28, 2022, and once again adjourned.

Crown prosecutor Matthew Hendry said “it is a very serious and lengthy matter” and said the prosecution and defence hoped to arrive at court with an agreed position in five weeks.

Garcia did not actually appear, but was represented by Legal Aid lawyer Alexis Oxley, who noted the defence had made a submission to the prosecution on September 2.

Magistrate Grace Kahlert ordered the prosecution respond by October 19, so they could advise the court how they intend to proceed with Garcia’s charges.

The matter was adjourned until November 2 for further committal mention in Ipswich Magistrates Court, and Garcia remained remanded in custody.
