An Ipswich dad was lucky to walk away from court a free man after he pleaded guilty to assaulting a woman in a road rage incident.

A court heard Graeme Troy Nunn, 45, was involved in an alleged road rage incident when he got in the face of a woman and spat on her.

Magistrate Virginia Sturgess told Nunn he was in no position to question the driving ability of others considering his extensive and relevant criminal history.

“You are old enough to know better regardless of the issues you had. It’s simply not an excuse to behave in this manner,” Magistrate Sturgess said.

“Spitting at someone is one of the most serious types of common assault - it shows complete disrespect and contempt for another human being…. (also) the risk of disease.

“You had absolutely no right to confront her in this way.”

Court documents from a 2017 Queensland Civil and Administrative Tribunal, reveal Dunn was unable to obtain a blue card to advance his karate career because of his extensive criminal history.

In 2018, the court heard the professional fighter broke a woman’s nose in an earlier road rage incident and received a fine for the assault.

The court heard Dunn’s criminal history was littered with assaults and dangerous driving offences.

During Dunn’s latest crime, the court heard he spat at the woman in June 2021 when Covid-19 restrictions were in place and it was “good luck” that any diseases had not been transmitted.

Magistrate Sturgess noted Nunn’s case was originally listed for a hearing and told Nunn he’s lucky he decided to plead guilty.

“Had you continued to show no remorse and been convicted after a trial it might have been difficult to argue you shouldn’t serve jail time,” she said.

Nunn pleaded guilty to one charge of common assault at the Ipswich Magistrates Court on Thursday, February 17, and was sentenced to a six month prison sentence suspended for 18 months.
