Daniel John Stumer pleads guilty to drink driving after doing a wheelie

A motorbike rider with four previous drink driving offences consumed almost an entire bottle of Jack Daniels at a function and was still well over the limit at 11am the following day, a court has been told.

A showboating motorcycle rider drew unwanted attention the morning after a big night out, with police pulling him up for a breath test after seeing him do a wheelie in a small Queensland country town.

The rider’s act of bravado was apparently the result of drinking too much Jack Daniels the night before, and Ipswich court heard this week.

It proved to be a costly move for the mechanic, who went before Ipswich Magistrates Court for sentence on a drink driving charge.

Daniel John Stumer, 36, from Boonah, pleaded guilty to drink driving at Wondai on Wednesday July 28.

Prosecutor Senior Constable Green said Kingaroy police were on patrol when officers saw the motorbike rider “do a mono five metres down the street”.

Stumer was breath tested and gave an alcohol reading of 0.070.

Snr Const. Green said Stumer had previous convictions for drink driving.

Defence lawyer Bill Leather said the conviction meant Stumer would have to go back on the Interlock device for the second time.

“It must have been a big night though. It was 11am and he (had that reading),” Magistrate Virginia Sturgess said.

“Yes he consumed the best part of a bottle of Jack Daniels at a family function,” Mr Leather said.

Ms Sturgess said Stumer was intercepted at 10.58am by doing something stupid on his motorbike that drew police attention.

She said his alcohol reading of 0.07 could not be regarded as being an error of judgment because Stumer had previous experience with drink driving offences.

Ms Sturgess said he had four previous offences for drink driving and should be an expert by now.

“You are old enough to know better,” Ms Sturgess said.

“At 36 it was stupid. No one to blame but yourself.”

The court heard Stumer had two previous convictions for high-level readings of .154 and .157.

Stumer was fined $850 and licence disqualified three months.
