Son breached DVO by turning up enraged on his father’s doorstep

His 70-year-old father called the police in fear after the enraged son turned up at his house and a fight began.

A 34-year-old Traveston man was convicted in Gympie Magistrates Court on Tuesday of breaching a domestic violence order against his elderly father.

The man, who cannot be named for legal reasons, pleaded guilty to contravening a domestic violence order in January 2021, and growing cannabis in his backyard.

The court heard the man contravened the order by turning up enraged on his father’s doorstep and aggressively banging on the doors and windows.

Once inside, a verbal argument ensued over family matters and he threw a coffee mug on the ground, smashing it.

His 70-year-old father then called police out of fear.

The man was also on a suspended jail sentence at the time of the offence.

Police prosecutor Melissa Campbell said the order had since expired, but the 70-year-old victim was not supportive of another one being issued.

Defence lawyer Chris Anderson said the man and his elderly father had made amends.

Magistrate Kurt Fowler expressed concerns about this, but Mr Anderson said the man relied on his father for transport as his licence had been disqualified.

The man was sentenced to three months jail, but was immediately released on parole for nine months.
