Magistrate slams serial offender: ‘When will you grow up?’

Expectant father who has been in and out of prison for robbery and dangerous driving was caught driving unlicensed 8 times in 10 months

Gympie magistrate Chris Callaghan jailed a man with a serious traffic history who was caught driving on a disqualified licence numerous times in the past ten months.

A SERIAL offender who has been caught driving on a disqualified license eight times in the past 10 months was this week slammed in Gympie court for his childish behaviour.

Magistrate Chris Callaghan told Max William Bourbaud Junior, 37, who is expecting his second child in the next month, his inability to heed to court orders would mean he would spend the next four months in jail.

"When is he going to grow up?" Magistrate Chris Callaghan asked the defendant's lawyer in Gympie Magistrates Court on Tuesday.

"This is the behaviour of an adolescent.

"He did serious time for armed robbery and he's still behaving like that?"

On December 4 last year, four days after Bourbaud was charged with driving unlicensed, he was caught driving on a disqualified license with drugs in his system and in possession of drug-related utensils in Tewantin.

On March 18 this year, Bourbaud was caught again drug driving on a disqualified license on the Bruce Highway at Black Mountain and on June 6 and 7 he was found driving disqualified in Nambour.

Appearing via video link from prison the former Noosa landscaper pleaded guilty to all driving charges from December onwards.

Gympie police prosecutor sergeant Michael Phillips told the court of his significant traffic history dating back to the 90s in Queensland and interstate including previous multiple convictions for dangerous driving that landed him in prison.

"He takes it upon himself to drive when he wants and for whatever purpose he wants including contravening other court orders," he said.

Bourbaud's lawyer Chris Anderson said he had been using methamphetamine at the time of the offending and accepted that his actions were wrong.

Magistrate Callaghan sentenced Bourbaud to 18 months jail, taking into account 73 days already served.

He was disqualified from driving for two years.

He would be eligible for parole on December 6 this year.
