Tyronne John Spencer in court for assaulting police, dangerous driving

A 32-year-old man who did burnouts in front of police, later assaulted an officer who caught him later that morning.

Tyronne John Spencer pleaded guilty to dangerous operation of a car while affected by alcohol, obstructing police in a public place while affected, assaulting police in a public place while affected, driving under the influence of liquor, wilfully making unnecessary noise, and failing to comply with a requirement to stop a private motor vehicle.

Police saw a car trying to do a U-turn on a one-way street in the middle of Gympie about 1.19am on April 20, 2022, the court heard.

They then saw the driver swap seats with Spencer, who had been in the passenger seat.

Spencer was then approached by police to do a breath test.

The vehicle almost hit the police officers who were trying to talk with Spencer and the passengers.

At 2am that same morning, police saw Spencer’s car rapidly reversing near the Queenslander Hotel, before skidding to a stop, revving the engine and doing another burnout, the court heard.

His car was then found on River Road, near Memorial Park, with the keys in the ignition and a can of alcohol in Spencer’s hand.

Police quickly took the keys out of the ignition and shut his door to prevent his escape, and saw a male passenger beside him, barely alert and another man passed out on the back seat.

After Spencer was arrested, he was walked to the rear of the police car.

At this point, Spencer became “non-compliant” and police had to push him into the vehicle, police prosecutor Kennedy Grills said.

Spencer hit his head, making him kick one of the officers in the stomach before apologising, lawyer Mark Oliver told the court.

He was taken to the Gympie Watch House and blew over the high alcohol limit at 0.17.

“It’s a night gone wrong,” Mr Oliver said.

Spencer believed he was not as drunk as his passengers as he had bought his mate a lot of drinks during a funeral, Mr Oliver told the court.

Spencer works in steel fixing for the construction of the Bruce Highway Bypass, the court heard.

He was given a total of 80 hours community service and fined $1600 referred to SPER and disqualified from driving for 18 months. Convictions were recorded.
