A homeless man said he “might as well” take advantage of a door left ajar at Red Rooster on the Bruce Highway to steal food and “feed the masses.”

A 39-year-old man who stole a tray of chicken from Red Rooster in Gympie told the court he did it to feed other homeless people.

Kevin Christopher Davis pleaded guilty in Gympie Magistrates Court on Monday, March 13, 2023 to one count of entering premises and stealing.

“Guilty as f---, Your Honour,” Davis said.

Police prosecutor Christie Mahoney told the court Davis broke into Red Rooster on February 26, just before midnight, and was captured on CCTV.

The security company monitoring the footage called police and reported he was seen leaving the business on foot.

Police who were patrolling the area found him at the amphitheatre at Nelson Reserve with a tray of food and he was arrested.

He told police he did it “in order to feed the masses” and he wanted to share the chicken with other people at the park, Sergeant Mahoney told the court.

Business owners confirmed no damage had been done and a door latch had given way or not been properly closed, she said.

Davis stole a tub of chicken wings, a bag of nuggets and three bottles of coke but no compensation was sought by Red Rooster.

Davis, who represented himself, said he was going to use the food to “feed the homeless”.

“The door opened and I was like ‘I might as well go in there’,” he said.

“It was quite a random experience, to be honest.”

He told the court he was on a Centrelink pension.

Davis was fined $400 and a conviction was recorded.
