A Gympie man whose was driving so fast at Teewah he failed to see a group of people sitting on the beach, was given a suspended jail sentence on Thursday for multiple offences, including dangerous driving and drink driving.
Dylan Peter Kelly, 22, pleaded guilty in Gympie Magistrates Court to those two charges, and to charges of unlicensed driving and obstructing police.
The court heard Kelly was questioned by police about 9.50pm on July 24, on the Freshwater Rd at Rainbow Beach. His Subaru wagon was pulled over the side of the road with a flat tyre.
Kelly told police he’d had six CC’s, the court was told. A breath test revealed a blood-alcohol content of .117 per cent. He was issued a notice to appear in court.
Two hours later, police were called to a camping zone at Teewah Beach, where they saw Kelly’s Subaru parked on the beach and Kelly himself walking along the beach.
After hearing the statements of several people, it was revealed that Kelly had embarked on a drunken joy ride through the camping zone, doing 120km/h in a 50km zone, running over a speaker and almost hitting a group of people sitting on the beach enjoying a few drinks, the Gympie court heard.
A witness also reported that when Kelly got out of his car, he appeared disorientated and was hostile towards the people sitting on the beach, it heard.
Police also reported that they found smashed speaker parts lodged in Kelly’s car.
When he was later questioned by police Kelly said the witnesses had been “all talking shit”.
Police prosecutor Michael Phillips told the court Kelly “was going so fast he didn’t even see the people on the beach” and was “driving like an idiot”.
Kelly’s licence was disqualified for 14 months and he was sentenced to 12 months jail, suspended for with 26 months suspension.
