Mistie-Lea Mott in court for public nuisance, obstruct police

A P-plater cleaner, who tried to use religion and fake urination to avoid inevitable drink driving results, has made a teary appearance in court.

An ‘embarrassed’ cleaner wiped away tears in Gympie Magistrates Court, as she relived a wild night in October when she drove drunk and caused a scene at the local hospital.

Mistie-Lea Helen Mott, 29, pleaded guilty to four charges on Thursday, including failing to provide a breath test, obstruct police, failing to provide a blood test and public nuisance.

The court heard the chain of events began around 7.30pm on October 27, when police pulled over Mott’s SUV in the Woolworth’s Caltex service station on River Rd.

Police prosecutor Melissa Campbell said Mott, who was driving and had one passenger she claimed was a stranger, then approached police and said “yeah, you’ve got me, I’m over, I’m done”.

She was on a probationary licence at the time.

Sgt Campbell said Mott first told police she was trying to “get away from her ex”, but clarified she had left the Mt Pleasant Hotel and was on her way to a Lawrence St unit.

Mott was breath tested five times, though she failed each time and became aggressive with police.

As a result, she was physically moved into the police car, but she fought back.

Sgt Campbell told the court Mott, suddenly irate, headbutted the inside of the car while screaming, and was told she would be taken to hospital for a blood test after failing to be breathalysed a sixth time.

She objected to this, the court heard, and said she was a Jehovah’s Witness.

However, Mott was taken to the emergency ward of the Gympie Hospital, where she continued to refuse to co-operate with police and medical staff and was later placed under arrest.

“While in the emergency department, the defendant threw water on the floor of the triage room, pretended to pass out and pretended to urinate on the floor, swore at hospital staff and generally created a disturbance,” Sgt Campbell said.

She was then taken to the Gympie watch house and later apologised to police for her behaviour.

Defence lawyer Chris Anderson described his client as “highly strung” and “incredibly anxious”.

“My client is very embarrassed by her behaviour,” he said.

“She is quick to (get teary) in respect of talking about this matter and her embarrassment … and the way she behaved towards police.”

Magistrate Chris Callaghan described Mott’s behaviour as “appalling”.

She was fined $1000 and lost her licence for nine months.

A conviction was recorded.
