Colin Mark Berry denied bail for alleged break and enter, wilful damage, breach of bail

A Gympie man accused of destroying the Sunshine Coast’s Spirit House restaurant now faces fresh charges following an overnight incident in the heart of Gympie involving the alleged theft of thousands of dollars worth of meat. Here is what the court heard:

A Monkland man charged with willfully damaging the high-end Sunshine Coast restaurant Spirit House has fronted a Gympie court on charges of breaking into a truck to steal “significant” amounts of meat in the dead of night.

Colin Mark Berry, 44, entered no plea as he made an application for bail from the dock in Gympie Magistrates Court on Monday.

He was charged with breaking and entering, wilful damage and breaching bail.

The court heard Mr Berry, who was an ex-soldier returned from East Timor, allegedly broke into the truck about 2.34am on November 18.

Mr Berry was granted bail in Maroochydore Magistrates Court for allegations of “destroying” the inside of the Spirit House in August, 2021.

The court heard the restaurant had more than $100,000 in damage.

The police prosecutor, who asked to remain anonymous, said there was a strong crown case against Mr Berry as the car used in the alleged break-in was the same vehicle allegedly used to break into the restaurant.

Magistrate Chris Callaghan said Mr Berry was on bail when he was arrested.

For the allegations in the Gympie court, Mr Berry was refused bail.

He was remanded in custody until his next court appearance on December 13.
